Holly Rios spent 66 days in the Westchester County Jail before her release on Wednesday. The 44-year-old New Rochelle resident was held there following her arrest on August 22. She has now been freed after pleading guilty to a misdemeanor assault charge.

Rios was initially charged with two counts of first-degree robbery, which are Class B felonies, along with one count of attempted second-degree assault. New Rochelle police arrested her on August 22. She was arraigned the next day, August 23, before New Rochelle City Court Judge Alexandra R. Bisesi. The judge set bail at $10,000 in cash, a $20,000 insured bond, or a $30,000 partially secured surety bond. Despite the bail setting, Rios remained in custody at the Westchester County Department of Correction in Valhalla, where she was booked at 3:08 p.m. on August 23.

Court records indicate that the attempted second-degree assault charge, a Class E felony, was reduced to third-degree assault. This change allowed Rios to enter a guilty plea to the Class A misdemeanor. She had previously pleaded not guilty to the attempted assault charge. The two original first-degree robbery charges do not appear in the latest case updates. The available records do not specify whether those charges were dismissed or withdrawn as part of the final disposition.

The court sentenced Rios to time served, meaning her jail time counted toward her sentence. The judge also imposed a mandatory $175 surcharge and a $25 crime victim assistance fee. Both amounts are due by December 28, 2026. The sentencing entry includes an order of protection. A notification from the New York Sheriffs’ VINE Service confirmed her release on October 28.

The case is docketed under CR-03987-26 in New Rochelle City Court. The latest docket shows an appearance before Judge Michelle Bernstein on October 28. This replaced an earlier scheduled appearance for November 4, which was associated with a Superior Court Information document used in felony cases. The publicly available records do not identify the alleged victims or detail the specific circumstances of the August incident.
